leave and license agreement is an agreement wherein the licensor temporarily allows the licensee to use and occupy licensor's immovable property full or a portion of it, for the purpose of residential use OR carrying business activity . For this, the licensor shall be paid by the licensee a fixed amount also known as the rent. In short, A leave and license agreement is a legal document that enables one party to allow another party to use their immovable assets, i.e., property, for a specific period without any change in the ownership of the asset.
In state of Maharashtra, leave and license agreement for any period, even less than a year, is required to be mandatorily registered. The provisions of Leave and License are incorporated in the INDIAN EASEMENT ACT, 1882 in SS. 52 TO 64. The implementations of these provisions is governed by the THE MAHARASHTRA RENT CONTROL ACT, 1999.

Signatures are captured using a biometric device and user details are verified using the Aadhaar database. The section relating to provision for Registration of Leave and License Agreement in The Maharashtra Rent Control Act _ 1999 reads as follows :
Sec.55 (1) Notwithstanding anything contained in this Act or any other law for the time being in force , any agreement for leave and licence or letting of any premises entered into between the landlord and the tenant or the licensee, as the case may be ,after the commencement this Act shall be in writing and shall be registered under the Registration Act, 1908.
Sec.55(2) The responsibility of getting such agreement registered shall be on the landlord and in the absence of the written registered agreement the contention of the tenant about the terms and conditions subject to which a premises have been given to him by the landlord on leave and license or have been let to him, shall prevail, unless proved otherwise.
Sec.55(3)Any landlord who contravenes the provisions of this section shall, on conviction be punished with imprisonment which may extend to three months or with fine not exceeding Rs.5000/- or with both.
Registration of Leave and License Agreement is Mandatory as per Provisions of Law. As per the provisions of Section 55 of the Maharashtra Rent Control Act, 1999, every tenancy agreement must be in writing with mandatory registration, regardless of its tenure.
Mere Notarization of Leave and License Agreement do not amount to Registration.
Unregistered Document has no Value in the Eyes of Law. No Police Verification of the Licensee can be Conducted by the Concerned Police Station without a Registered Documents.
The Responsibility of Registering such Agreement shall be of the Licensor.
The Licensor may have to face a Criminal Action If he do not Register the Leave and License Agreement. The Licensor will also be Liable to be Punished with Imprisonment up to Three Months or with fine up to Rs. Five Thousand or with both.
